urgent suggestion

the plot of andhra pradesh housing board is been auctioned under paper notice, A has bidded for it and successfully got the plot in his favour by registered sale deed by APHB. A has obtained loan and paying interest to bank since 17months since the puchase of plot.

now suddenly a notice from highcourt is rec by A , writ petition filed by B claiming the plot from APHB, by submitting the doc spcifing that B had been alloted the same plot in 1993 and he had paid 50% amount and delayed the remaining balance.so the APHB has cancelled the allotment in 1996. now he want to pay the remaining payment with penal interest and obtain the same plot or a new one. he also claims that the plot was alotted to him in sc category. which cannot be given to oc.

so please suggest wether to implead as respondent 2. or the advocate of APHB wiil protect us by fighting as rsp no 1.

In the above circumstance of the case which you have mentioned. The wirt petition is not the right remedy for B. He  should file a civil suit against APHB in civil  court.
