Validity of oc

Madam/Dear Sir, 

On 1st Nov, 2013 we occupied our new flat in Koparkhairane, Navi Mumbai. In copy of CC given by builder following are mentioned'( We are in the process of formation of Soc)

1. That  stairs should be separated from lift  by fire proof , self shutting doors.( bldg is G+11). Doors are neither fire proof, nor  self shutting. 

2.That builder shall provide  Solar Water Heated water supply system for all washrooms and kitchen.

Secondly, in the brochure builder had written intercom, video -door phone etc. These have not been provided.

We had written a registered letter to the builder for these items. During our discussion, builder said 1 and 2 above are not mandatory, not required.

He also added that what ever is shown/written in the brochure may or may not be provided. The builder claimed that intercom and video-door phone was not shown in the sample flat hence shall not be given. Some buyers had purchased flat when it was only a barren land. They took decision based on brochure. Some buyers purchased flat when it was half/full built. They saw actual flat and did not see the sample flat.

What are the legal provisions? What is the status of a brochure?

send a legal notice and wait for their reply for 10 days. If you does not satisfy with their reply, After that file in consumer forums.
