Victim of 498a

Hi

Today Police said me that they have send Chargesheet to Court long back but when i went in court court said we have not got chargesheet from police. Wht to do now?

I think police r not intentionaly filling chargesheet coz bribe from my wife side.. wht to do?

Can i make RTI to Police when chargesheet filed or is chargesheet filed or not? if filed then date and time?

If any one have format then plz paste.

It takes 1-2 months for chargesheet to reach court as it is filed by police in circle office from where it reaches court. You will get summons from court once it is filed so why you worry about that. Even if the other side has bribed police not to file chargesheet then also it would not benefit them.

 

RTI is helpful you can file that.

498a is very serious offense.Stall the chargsheet by moving the High Court and prohibt the lover Court from receiving the chargesheet. Why did the cops not jail you instantly? The matter will be quashed on this very ground.

If that is the scenrio of the case better utilize RTI.

How would RTI help? Beats me.

 

Why can't you wait for summoning? What purpose would be served if you know the contents of the Chargesheet before hand?

 

You would officially get the copy of chargesheet.

Shonee, I'm advising off the cuff as the querist has posed a query off the cuff. Who's the querist? Complainant or the accused? A complainant can visit the police station to find out the reasons for delay. An accused won't go the ask police the reasons for the delay. Most querists here write off the cuff. How can any lawyer properly guide them if they don't frame their questions properly and with clarity.

Shonee: Querist has not even specified which section of the IPC was used and why it was used. Cops all over the world take bribes. But in matrimonial disputes they try not to aggravate family problems by entertaining all types of phony cases filed by husbands and wives against each other. Additionally cops have families too and never get bribed by either husband or wife. Many Lawyers and judges in India have no scruples and cops know that and even state that openly. What's wrong if cops try not to aggravate family matters?

i think is this present case part's lawyer has advised that, bail may be granted after filing of C/S.most probably

some of the accuseds are running for bail.
