Venkat,
Sec 164 of Cr.P.C. relates to the provision for recording of confessions and statements by a MM or Judicial Magistrate irrespective of whether he has jurisdiction or not in the case, made to him in the course of investigation under this law or any other law for the time being in force or at any time afterwards before the commencement of inquiry or trial. This has got nothing to do with the bailable or non-bailable offence.

Hey Mr. Venkat, in your previous Tread you have told that the elders have negotiated the matter for MCD and you are coming up with all these questions. What is the baseline you are looking for?
If they have negotiated the deal and ask your wife to withdraw all the false cases, why are you simply misleading the members here, speak to your advocate and get the MOU done.
Best of Luck
