Whther refusal to do marrage on the mandaap amaounts Dowry ?

I ma citing one instance which has happened in New Delhi vasant Kunj area some what 8-9 years ago in which one woman has lodged the case against her finnance and his parents for allegely  demand of dowry and put them behind the bars and the girl turned hero by media and other newspapers and the Govt is so much impressed to introduce a chapter in the middlce classes

Her name was Nisha (?). After few days one man claimed to be the husband of the girl and admit that he has informed their in laws that she has already been married which has caused to break down the marraige on the fixed date

Now question arises if any one met with same situation whether refusal by the groom on the fixed date can put him behing the bars?

Legally not, but illegally in the case of police with pressure or approach, YES.

But the onus is also on guy who is refusing to  marry at mandap. If he has the Knowledge about the antecedents of girl he should decline at earliest.

The police put pressure on the innocent guy and compel him to marry but it advisable he should not proceed

Misuse and abuse of the provisions of law either by the girl or the police cannot be overruled unless the truth comes to light after the law takes its own course. Also, there is no doubt media mostly tries to exxaggerate the things to mislead the public by creating spicy stories..

 

Refusal to marry, unless sufficient proof for demand of dowry is produced should not have been treated as a dowry case. On the other hand, if the boy alleges the girl having already married with some other guy, he is also liable to prove his allegation beyond doubt.
