Why India is member of Commonwealth of Nations?
N.K.Assumi (Advocate) 25 October 2009
On 7th may 1949, our Constituent assembly accepted the declaration of the Commonwealth Prime Ministers' Conference.India agreed to the acceptance of the King as the symbol of free association of independent member-nations and as such the Head of the Commonwealth. In the words of Pandit Jawaharlal Nehru: " It must be remembered that the Commonwealth is not a superstate in any sense of the term. we have agreed to consider the King as the symbolic head of this free association. But the Government has no function attached to that status in the commonwealth. So far as the constitution of India is concerned, the King has no place and we shall owe no allegiance to him."

The King or queen of England is merely a symbol of the free association of independent members. It is essentially a political act of foreign policy and it has no legal or constitutional importance. If India was not a member and Pakistan was a member of the Commonwealth, India would have lost a lot. Remember during the war with china Soviet Union told the Government of India that China was her brother and India only a friend. The fanatics of its time werec willing to join Soviet block, they want to come in terms with China at any cost but they want India to leave the Commonwealth. Joining Commonwealth is not an abdication of our independent status. For example, Tanzania broke relationship with Great Britain on the issue of Rhodesia, but Tanzania did not leave the Commonwealth and continued to play active role in the affairs of the Commonwealth.

Nations like Pakistan keep going out of and into Commonwealth. It is no more than a club of nations like the U.N. has turned out to be.

Detailed reply has already been submitted. Nothing to add therein except the fact almost all members of common wealth had been one time colonies of UK and this is still a symbol of supremacy of Their Lordship......

Colombo Plan is dead. So are SEATO, CENTO, BAGHDAD PACT, ANZUS, NATO, COMMUNIST RUSSIA., NAM.
Commonwealth is in the pipeline. It is the national interest that is supreme.

Remember a symbol has got importance ... remember the 'salt satyagrah'? it was a turning point in our freedom struggle even though it was symbolic violation of law ... mahatma gandhi's motive was not to do business of salt, it was to make a little salt, only to give hope to the people of Indian subcontinent ....
a bad and rude example ...

Do you think that judiciary has power in this matter ? Can supreme court of india accept the patition of " violation of fundamental right of freedom - freemdom of India and its people symbolically " as it is humiliating to be under any king or queen even symbolically , an example is there ... during the commonwealth games held in delhi the president of india was not supposed to inaugurate the games even when the queen was not present ...

SC will do no such thing. It does not work on sentiments unless it itself choses to do so.

If CBI had been under SC, country's ILL would disappear.
