Former Madhya Pradesh HC Judge passes away; HC honours her by not conducting Death Reference [Read Letter]
 
 
In 2014, Former Judge of the Madhya Pradesh High Court, Justice Manjusha P. Namjoshi wrote a letter to the Administrative Judge requesting not to conduct death reference on her death, and not to suspend judicial work either. 
 
 She had written further in the letter “what I feel is that we as a public or government servants or constitutional authorities are trustees of the public as such and therefore there is no reason why we should commit breach of trust by suspension of work on such events.” 
 
 Justice Manjusha passed away on 15th April 2015. The Full Court meeting held resolved not to conduct death reference in memory of the late judge. The Chief Justice issued a note of condolence.
 
 In his note of condolence, the Chief Justice of the Madhya Pradesh High Court described the late Judge as “extremely painstaking person” and said “this gesture is laudable and worthy of emulation by one and all, for upholding the constitutional mandate of rendering speedy justice. The magnanimity and altruistic persona of her Ladyship was unrivalled”
 
 Justice Manjusha had joined judicial service in 1970. She was elevated as High Court judge in 2005 and she demitted office on 2009.

Why only judges? MLA's, MP's, ministers and so many others also should follow suit. Instead of waiting for a will, the practice of declaring holidays on the death of persons should be abolished

I had once seen a judge in the High Court of Delhi who was intimated of passing away of his elderly uncle (former Judge himself) in the middle of a regular hearing day. The lawyers and litigants were not aware at that moment. This Judge continued to hear matters with a determined expression. It was only after some time had passed that the senior members of the Bar came to know of this and requested the Judge to leave that he finally adjourned the Court for the day.
