Work Hours in India

Is there a stipulated advisory on the number of work hours for software professionals in India? I know a startup in Chennai which is forcing for more than 8 hours from Monday to Friday and at least 6 hours on Saturday also. This company has one of its office in US also but managed by desis.

8 hours a day, does not include lunch break etc.

48 hours/week.

Usually companies mention in the appointment letter workdays in a week and office timings or in circulars. If the company has given it in writing that wordays shall be 5 day/week,and has not withdrawn it in writing, then it is a seperate matter.

Is this firm registered in India and has it taken mandatory licences and displayed the same at the entrance/reception.

The employees must be signing date and time of entry and exit in the register or punching their matrix cards.

Companies usually assign the designation of executive/manager to the employees to give impression that they are not workman and hence not eligible for overtime.However the labor act and nature of duties etc shall determine the category of employee.

The employee/s  being forced can lodge a complaint with labor authorities. They shall do the needful.

I think we need an association of software professional. Companies explolites and many times does not fullfill promises. We really need an union sort of thing to oppose autocracy.

Very much. I have come across a Facebook Venture called 'Microsoft/Google Purchasers' which details about such cheap software concerns. At the outset it looks to be an amateurish attempt. Just sharing that link here so that legal professionals can help out the  creators of the group to make it successful.

According to Factories Act"1952

Maximum Working Hour/Day is

8 Hours + 2 Hours Overtime = 10 Hours & 48 Hours in a week.

Overtime is 2 Hours/Day & Not Exceeding 12 Hours/Week & 50 Hours in a Quarter.
