You produce the documentary proof, and file your Affidavit about her Edu Qualification, Job experience, her present job / business and income thereof. 

If it matches with her living  to your standards, she will not get mtn order.

Does RTI  Display of salary of worker on website of govt institute with the name of candidate will be valid and accepted by the judge ?or need to file and get  only written RTI reply from the institute  .as it would take around one month or more ,ehat the institute told me.and i have to appear in maintenence case before that.

if ur next date is within 30 days from now, then on next date request the court to grant next date on the ground that u r in the process of getting the proofs of the work & education & the salary of the respondent wife.

printouts of the info. displayed on a website are not admissible in evidence.

file RTI application to wife's office address and request for the cert. copies of the salary slips for last 3 (or more) months.

also get cert. answers to the following questions :

working since when ? (date of appointment)

designation.

detailed salary including all detailed allowances etc.

send amount (approx. 4 rs. per page * expected no. of pages) along with the RTI application by Money Order.

send application by regd. post / speed post and request for the info by Reg. Post / speed post

also mention on the application that the info, is required for court proceedings - it may expediate the answer

get the phone no. of RTI officer and talk to him over phone / go & meet him personally and request - it may expediate the answer

i did lot of RTIing in my cases, & was benefitted beyond expectations.

perjury can be filed any time before the final judgement.

if u file it now, it will delay the case ... so decide what to do

dont forget to add postage charges in ur MO.

if u send excess money, the excess amt. is returned by the office.

always better to send 50-100 rs in excess

first of all you need to prove in the court that she is able to maintain herself.

if she lied under oath in court then only you can file perjury.

rahul ---does it mean perjury cannot be filed just on the basis of her submiting afidavid that she is not working ?

u need to prove that she is working or she may file in later stage of case about her working status which will  be contradictory to previous one.
