Written statement to be filed in divorce petition

In a divorce petition?

Can WS be filed after counsellors Report ? 

What if even on the expiry of 120 days mentioned under Order 8 Rule 1 Counsellors Report has not been filed before family court?

What could be the consequences of such non filing?

File written statement as per law. That process has nothing to do with counselling.

You must be able to file the written statement without any hurdle. Counseling/mediation is only a way for the court to check if reconciliation between the couple (applying for divorce,) is possible. If an amicable settlement can be reached, the petition would be withdrawn. Otherwise, the divorce proceedings would follow the usual course.

There is no limitation for time in these matters except expressly stated where you are asking for particular relief.

You can file your witten statement whenever you want before the judgement is passed.

You can make oral submissoin too as pointed by above Ld Adv.
