Appeal by tenant

RCOP case Tamilnadu.controller issued Eviction order on 11/4 section Not paying rent for 48months & also the house for the use of the land lord. EP filed & the tenant moves for appeal in Principle sub judge.IA petition for time delay will the court accept & chance for stay? how long it will take to complete this appeal petition.?

Unless and until the stay is granted by the appellate authority to stay the order of the eviction order passed by the Rent Controller, there is no legal bar to execute the eviction. Since the appeal has not been entertained so far because of the condonation of delay petition is pending, the land lord very well get along with the Execution petition.

 

Normally, the Courts will condone the delays in a liberal manner. The disposal is subject to the work load of the Court concerned and the co-operation of parties.
