Encumbrance for same period shows diffferent owners

Hi,

We have situation where we had taken encumbrance for period 1997 to 2000 and our name shows in the encumbrance but now another person has turned with encumbrance that shows that in 1998 the property has been sold to him. How is this possible? when the same is not reflecting in our encumbrance taken in 2000?Id

Ideally when we took encumrance from 1997 to 2000 in case the property has been sold in 1998 it should be reflecting in the Encumbrance certificate?

Is it possible that the other person has given money to known person inside registrars office and changed the Encumbrance details??

Mushtari hoshiarbash ,"buyer beware". the buyer should be very much alert and should not depend on the non encumberance certificate given by the Sub Registrar .First of all the title deeds availble with the seller be checked,Try to have look on the origuinal title deeds and not the photocopies.Then a personal visit should be made to the Halqa Patwari for verifying the status of the property under reference in the revenue records.One should not forget to personally visit the property and verfying its status from the neighboures.

dear sir 

   it is not possible to entered any information without executing the document and in your case first you verify the boundries and area of your peroperty and then verify the boundries and area of the other reflecfing details b'cos some time the house/flat number similarly mention in the deeds which create such situations.
