Non refund of booking amount by the udb jaipur

Dear Friends,

I had booked a flat in UDB Orchid scheme of Unique Dream Builders Jaipur. The flat was booked on the promise by the sales representative of Unique Dream Builders, Jaipur that it will be completed and handed over in 2 years of the booking date (Please read this as Sep, 2012 for the completion date). Also, the built up area in the plan was 552 sq. ft. at the time of booking.

 

I had given the booking amount of 2,02,000 through cheques with details as follows-

1)      Rs 51,000 dated 03/09/2010, Receipt dated 27/09/2010

2)      Rs 51,000 dated 30/09/2010, Receipt dated 11/10/2010 &

3)      Rs 1,00,000 dated 30/10/2010, Receipt dated 01/11/2010

 

I had submitted the document with the Bank and had also got the home loan sanctioned on 3rd Sept, 2011. However, when I received the agreement papers from your representative there were the following points of disagreement-

1)      The built up area was suddenly changed to 578 sq. ft. instead of 552 sq. ft. at the time of booking without any intimation.

2)      The time to complete the project was mentioned to be 48 months from the time of agreement date (I received the agreement in Sep, 2011 (after one year of constant follow ups),  hence, by this clause, the completion date suddenly becomes Sep 2015).

On the above mentioned points, I asked the officials for refund of my money along with the interest calculated at prevalent rates for the period the money has been with the company. After constant follow ups with the sales guy and also with company officials, I wrote a formal mail to the company's e mail id info@udb.in on 17th April, 2012 but there has been no response whatsoever from the company's side.

 

Please guide me about the procedure/steps which I can take for getting a refund. Also, because of the discripencies I had not signed the agreement.

Same type of problem i m also facing right now.

Alternative option-I: Legal Actions.

1) Log on to https://www.icrpc.org/

2) Rest things this NGO will guide you & also you will find the details in their website.

Alternative option-II: Settlement ouside of court

1) Try to settle the matter with the help of a third party person in that locality.
