Notice period before depositing a security cheque

Respected Members,

A friend had requested services of a Placement agency on payment of an amount for a job on a promise that if the placement firm does not place within a period of time, the money will be refunded.

A post dated cheque was issued to him dated same as the end of the aforesaid period as a security.

I would kindly like your help to know the following in case of non fulfillment of promise:

1. Whether it is required by law to give a notice to the Placement agency before encashing the Security Cheque?

2. If yes, how many days before should the notice be sent?

3. Is notice by Email & SMS to the Director admissable for the same? (Any format of message, if possible)

Any other info which I may be missing out.
