We purchased a flat in 2005 and the sale deed was made in the name of my wife. She has given me GPA and i signed the sale deed, got the bank loan from IDBI and then transferred the same to ICICI also.
Now we wanted to sell the property and my buyer is also going for a loan from same ICICI bank. Bank has raised a query saying the sale deed signed by my wife now and the sale deed we did in 2005 dont match.
They dont match because she gave me GPA and i had signed.
What we found out is
1. There is no mention in the sale deed about the GPA holder signing on behalf of the buyer (My name was not mentioned in the Sale deed as GPA holder signing)
2. It was my wife name, my photograph and my sign.
3. House Tax is paid on her name only.
3. Unfortunately we have also lost the GPA that was done in 2005 and not sure if that was registered or not.
Wanted to know what is that we now have to do to get this mistake corrected and ensure my buyer gets the loan from the bank.
My wife is currently in India on short visit and i am out of country.
