Society transfer charges for resale flat

Hi

I own a flat in Kandivali Mumbai and wish to Sale the same

I have found the buyer and we both have contacted the Society Manager for Transfer of Property Documentation requirement

The Manager Gave the Below Details, I want to Validate the leagality of the same whether this is True, since this is a direct deal and no broker is onvolved in this

1. the TDS of 1% to be deducted by the buyer and provide TDS certificate copy to the Society

2. Rs. 25000 for Society Transfer to be paid equally by the Seller and Buyer

3. Development Charges of 25000 to be shared equally by the Seller and Buyer

4. Legal Charges of Rs. 2500 to be paid by the buyer and seller equally

Do let me know which charges are legally payable and Society and enforce the same and which are the charges which can be denied by the seller legally and society cannot enforce

1.  Society has no jurisdiction to ask /demand for:
a)  TDS certificate
b)  Development Charges of 25000
c)  Legal Charges of Rs. 2500

2.  The above is illegal and prosecutable in a Consumer Court.  A complaint also can be lodged before the Registrar of Coop. for such demands by Society.

Shri Hemantji has attended the queries very aptly. Society has no legal right to demand the amounts as per item nos. (1), (3) & (4) of the query.
