Apology letter from bank for non closure of loan account

Sir/Madam,

 

Issue :

One of my friends had availed a Personal Loan from a certain bank in 2009. However due to some family problems he couldn’t pay the installment in 2010 due to which he committed a default.

After much talks with the bank officials the bank agreed with the settlement amount and both the parties agreed and simultaneously he paid the amount and the issue is settled.

However now in the year 2012 when he goes to some other banks/nbfc’s his loan form is rejected. Now when he goes to ICICI Bank its found out that the loan account is not closed and its shown as default.

I guess the CIBIL Report states that his Civil Payment Record is not good.

When he asked for an apology letter the bank refuses.

My Query :

1)     Can my friend file a case before the consumer forum asking for some financial remedy and a apology letter from the bank that he has been mentally harassed for this issue.

2)    Do we need to take the CIBIl Report which may state that his loan is getting rejected since the ICICI Bank Personal Loan is not cleared.

Lonee wont come under the defination of consumer .  He cannot file.
