Change in owner name in notorized agreement

My brother (1st owner) and father (2nd owner) had entered into an agreement for a flat 3 years ago. The agreement was notorized but not registered. Unfortunately, my brother passed away few months back. I now want to get my name added to the agreement so that I can manage the affairs in future.

Q1 - What is the process of changing the names in the agreement. Is it simply getting another agreement made with new names and notorizing it?

Q2 - The original date of agreement was 21-Mar-2011. All clauses of delivery were as per date of agreement. So in case builder defaults on delivery, the period from agreement would be taken to enforce any penalty. Now since we are doing the agreement again, will date of agreement be taken as current date or will the old agreement date still hold good. Should the agreement still mention the old agreement date. Does it matter if the agreement date mentioned is 3 yrs ago while notory is done at current date.
