Please give me some references of sec 12 and sec 22 of SICA Whether proceedings of Consumer redressal forum is barred by the order of BIFR declared the opp.party a Ltd. company as SICK COMPANY" some citations needed about bar of proceedings
consumer cases are not barred when a company's reference is approved by BIFR or proceedings are going under AIAFR since this s not a proceeding which affects the assets or otherhings which is a subject matter under the revival or so. like taxation matters are not covered under the bar of sec 22.
there are cases on the said issue but i dont remeber them and it will only be possible when i get time to work for those cses. go for some book on rehabilitation of companies and you will find plenty of cases on the said issue.
