Custody of daughter

Sir,

I am an NRI. My wife died due to cancer and before a week of her death, she filed 498A case and pending in court. Which I will win as I got all the evidence that I have not taken dowry and spend 40 lakhs for her treatment.

Now my 2 years baby is with grandparents and they are not giving to me. I filed a GOP 1year back and still, the case is in FILLING COUNTER by the opposite lawyer, the delay is due to PO transfer.

I came to know that Grandparents want the money of 10 lakh for giving my baby and also heard that they are teaching her that she doesn't want to go to father.

Please help me on how to get my baby fastly. I Filed GOP case in AP and I am resident of Karnataka and my baby also born in Karnataka. Is there any way that I file a case in Karnataka to get my baby.

Petition for custody can be filled where child resides presently, being natural guardian and biological father you have all right of your Child Custody.

You can simply file a complaint followed by a habeas corpus petition In the High Court of the child's jurisdiction

Yes, being the only natural guardian you can approach the High Court under Article 226/227.
