DISCIPLANARY ACTION

Dear Sir,

Is it any procedure that the concern department head issue 'SHOW CAUSE NOTICE' directly to the section workmen without knoledge of the HR Department ? In such case what is the role of the Manager-HR ?

It is always better if the small issues are resolved at departmental level. But a copy of Show Cause Notice and Reply must be sent to HR for record so that the same cn be reffered in future if required. Departments can seek help in drafting the SCN and deciding the further course of action.

Department must be taken into condifence and be explained the legal comlications involved in it.

disciplinary proceedings starts from the point chargememo has been issued by the controlling officer or disciplinary authority.

Disciplinary action should  start  from the HR  department. the reason being  the notices which are issued  should be legally  correct and  natural justice should be followed. the production personnel  have nothing to do  with this. as a first step , they can advice, warn  or give a simple memo  which will establish that the employee  is  being  given chances to correct himself.  a  show cause notice  should adhere to all legal principles and it will be better if it is handled by HR person.

if  any notice is given without the knowledge of HR person, and if something goes wrong the Hr  person will not be responsible.this has to be clearly intimated to the top management and it should be made clear that each department has to role to play for proper functioning .
