Fraudulent obtaining documents

Back in 2019 Ananya and Raj got married. But due to the pandemic she (Ananya) did not get

a chance to get her marriage certificate. A few weeks ago Ananya discovers that her marriage

certificate was fraudulently obtained by her spouse, Raj. She wants to challenge the

authenticity of the certificate in court. What are the legal steps Ananya needs to take to

challenge the fraudulent marriage certificate? What evidence should she collect to prove the

fraud? What legal provisions under Indian law can she rely on to contest the certificate, and

what remedies might the court provide, such as annulment of marriage or legal consequences

for Raj?

In order to obtain a marriage certificate both the parties i.e., bride and groom has to be physically present before concerened Registrar of Marriages.

If she is not denying the marriage then there is no question of annulment of marriage. The marriage certificate itself is not a valid document to prove the marriage.If you want to cancel the fraudulently obtained  mariage ceritifcate you may file a suit for declaration to declare the marriage certificate as fraud and to declare it as not enforceable or not valid.
