High court mediation

Dear Lawyers and Friends,

Could you please advice me the procedure for doing the mediation of married couple in higcourt mediation centre.

What is the fees of the councellors and how efficient it is.. this would really help in taking the decision for Divorce?

There is no 498A and DV case till now, looking for reconciliation/ Medaition.. husband has filed Divorce case on the ground of cruelty.

Dear Smriti,

 

As per Sec. 89 of the Code of Civil procedure the matter may be referred for mediation by the presiding officer if the parties are willing to settle their disputes or there is any possibility of setlement.

 

The mediators are mostly comprised of:

  1. Retired Supreme Court/High Court Judges.
  2. Legal Practicioners having exprience of 15 years or more before the High Court/District Court or an Equivalent court.

 

They explain the process of the mediation to the parties when the matter is forward to them.

To add

1) I think ur case is at Family Court OR ADJ court, so no point HC mediation center coming into picture

2) Mediators there are NOT PROFESSIONAL ONES. They have no training in human psycholgy or psychotherapy. Do not expect much from them. If both of u are educated & are willing to sort the matter out of court (in either way), much better option.

3) Family courts also have mediation cells attached to them at each distt level. Judges also make n number of attempts to mediate in court rooms/chambers
