Dear friends,
I Would Like to Know that in Case the deserted wife during the stay at her parental home in already filed case for maintenance against her Husband who is well equipted and refused to live together can move an aplication for the interim Maintenance because the case for the same relief is now Too Old left to be decdide and the family position such gril is very worst.

First tell me whether she has moved the
main petition under section 125 or section 18, if the petition is under
section 125 she can claim interim maintenance under same section. if it
is under section 18 she has to file a petition under section 24. She is
entitled for interim maintenance. for further clarification you can

Then she can file a petition under
section 125 itself seeking the court to grant interim
maintenance, during the pendency of the main petition

What if the lady has deserted the husband and the man has reasons and proof to prove it. Will she be getting pendelite maintenance under section 18 and 24 of HMA? Becuz Law is clear that if desertion is on the part of lady; she is not entitle to maintenance?

and to add, if women has deserted husband due to impotency in husband, what recourse is available to her
