There is a situation where a woman X had send several sms's to another woman Y,When the fir was logged by woman Y-she had stated that the sms she recieved were sent by her husband as she is going through a Divorce case - However after police investigation it was found that woman X had send the sms.
Woman Y is in an extramarrital affair with woman X's Husband - Mr.and Mrs. X are also seprated but not divorced and still meet due to their child .
IT Law 2000 section 509 IPC sec 67 was enforced by the Police at the time of filing the chargesheet in the 7th Month after the mesgs were send. Woman X have surrendered the Phone and simcard and have obtained the anticipatory Bail .
Woman X claims that she had send a mesg to her husband a day prior and she did not recieved any response from him .But then woman Y whose number was not avaialbe to her started calling and sending texts to which woman X replied and this is how she found out woman Y's number and untill a few msges exchanged - woman X did not know It was woman Y - and when she came to know she sent her stinkers ,but did not disclosed her identity and continued to talk like a male respondent . Both woman exchanged abusive mesges but intent of the sms's were not for the woman Y atleast when it all began.. but were for womanX's husband .
Woman Y herself called for it . Mr.X and Mrs.Y were together at the time of sms Exchange ! Possibality can be worked out that the same was done by Mr.X .
So please let us know what can be the best way to get woman X out of the same. As her intent was for her husband - when she knew she was talking to a homebreaker - Neither Mr.X or Mrs.X has still filled Divorce .
Need Woman X to get justice as she thinks there was no intent to send any mesgs to Woman Y , Husband of X has tried to play in but it is still not clear - Need your views and valuable updates to protect woman X out of it as she is in distress already due to infidelity by husband and no maintance for herself or child !
