Jurisdiction of consumer forum

A private Bank Sold a property to a person by public auction by issuing tender notice in daily newspaper under sarfaesi act, but said property already acquired by Government, Bank also well known this fact & hide this & sold the property to a person fraudly. Now that person filed a complaint before the consumer forum for damages and refund his money with interest. Now consumer forum questioned whether this forum has the jurisdiction to entertain this case.
