Lease agreement not registered

Hello all

I have leased a shop of mine to a tenant for 7 years out of which 5 years is a lock in period. The tenant stands to pay me 5 years of rent incase he backs out. Its been two years now  and now the tenant is saying business is not doing well and wants to vacate. The tenant is saying he cant pay 5 years rent and will not vacate until his advance comes to zero by deduction of rent.

What are my options in this case? My deed is not registered.

Dear K Rao,

Lease Deed is a compulsorily registerable instrument.  You can't enforce the terms of it in a court of law, for being un-registered.

Give a statutory notice through an advocate demanding your tenant to vacate the premises for non-payment of rent and get him evicted by due process of law.

Better to consult an advocate.

The lessee must pay rent without any demand from the Lessor.

Thank you for your responses. I will contact an advocate sometime next week but can a tenant stay until the end of deposit held by the landlord? If this is something legal I would not like to send a notice since we still share a cordial relationship.
