Letter of administration

My Father expired intestate in January 2016. He (first holder) and my mother (second holder) jointly own a flat in Mumbai. Me and my two sisters apart from my mother are the legal heirs. Me and my mother were the nominees however I have released my nomination in my mother's favour and we submitted the application along with "indemnity to refund the expenses" towards transfer of flat in favour of my mother ,to the society. I understand that post the advertisement and other society processes the flat will be transferred to my mother's name as a trustee for my father's share (50%). Balance 50% shares are already on my mother's name.

Me and my sisters want to release our claim on this property in favour of my mother. Me and one of my sister are residents of Mumbai whereas my other sister resides in USA. I understand that letter of administration is one of the options and probably the best fit for property transfers in Mumbai. We are aware that the court fees(max.) are Rs. 75000/- .

I request opinions on this matter including the processes, timelines, cost (court fees, expenses and  professional charges) and contact details to initiate the matters at the earliest.

It is believed that you are Hindu.

The matter is of inheritance.

The nomination in society is not a parallel route to succession.

The CLassI legal heirs of deceased Hindu male i.e; Mother, wife, sons, daughters shall share estate equally.

Anyone can relinquish in anyone's favor.

Thanks Mr. Kumar. Yes we are hindus and this matter is of inheritance. We are looking forward to engaging an advocate (Bombay High Court) for advise and appropriate action on this matter.
