hello all learned friend

an accused arrested for the offence of rape and  mobile of accused taken by the  police as mudamal now i would like to take back by the order of court but in the such application affidavit is most important if accused produced bill and affidavit claiming the mobile what is the effect in the  trial whether it is wisley to put the application after the chargesh*t and accused is in jail case is bad so not bail application  put before the  court pls suggest thanks

ACCUSED RELEASED ON BAIL.OTHER WISE IN NON BAILABLE OFFENCE LIKE IT IS BETTER TO CLAIM MOBILE AFTER FILING OF CHARGE SHEET, AND RAPE IT WILL BECOME DIFFICULT TO  RELEASE ON BAIL.

Well suggested by Mr. Patil. But u can take signature on vakalatnama from the Accused on custody and u can file an application to get back the moblie with the help of the family members of the accused,
