Dear experts plz suggest regarding the following One person A assured B to provide employment in abroad collected amount in various heads.... couldn't able to fulfill his words. B insisted for repayment, then A sought time executed a unregistered deed for repayment in certain time limit, and also given cheque. B Said cheque at his banker, the same is bounced with insufficient funds.... In such situation can B file a complaint under NI act

Do not waste time, contact a local advocate, and get issued a legal notice demanding payment in lieu of a bounced cheque. immediately.   The law has a prescribed time frame and a limitation. period.

You can file case under Section 138 with the help of a local competent and reliable Lawyer.

 

Ensure that all records are available which need to be filed alongwith case papers in the court.

You have no chance to succeed the case as you have given him unaccounted Money for illegal purpose.money given by you does not come under the purview of debt or liability.

1. Based on the "unregistered deed for repayment" and the "bounced cheque" that you are holding, you may file "cheque bounce" case u/s 138 N.I.Act and also separately file another private criminal case of Intimidation, Cheating, Fraud, Mischief, etc....  and also separately file "Recovery Suit" in the local Civil Court, for the principal amount & interest etc....

 You may file "cheque bounce" case u/s 138 N.I.Act. You can file a complaint under Section 154 Cr.pc in the Police under jurisdiction. You can also file a private criminal case of Intimidation, Cheating, Fraud, Mischief, etc....  and also separately file "Recovery Suit" in the local Civil Court, for the principal amount & interest. Please ensure that the legal notice must be issued within 30 days from the date of the receipt of the information of bouncing the Cheque and after waiting 15days you can file the complaint within 30 days.

File a case u/s 138 of the N I Act and a criminal complaint for cheating fraud mischief intimidation etc. through a local prudent lawyer.

Yes, you can file an action under NI 138 as well a criminal complaint.

In my considered opinion, you had not indulged in any illegal activity; rather you have been the victim of  a deceitful activity
