Night shift allowance in bank

I am working in a bank as an executive in cheque clearing CTS department in back office I have done night shift for many weeks but bank don't pay night shift allowance also doesn't pay overtime,  we are working more than 9 hours daily excluding 1 hour lunch break.

I have seen almost many banks provides night shift allowance so if I formally ask HR to pay me extra for night shift will I get allowance or not. What if hr refuses to give allowance can I take legal action against bank 

 

My salary is 15000 in hand

Waht are the conditions that have been mentioned in the employment offer letter in this conection?

If it is mentioned that you are entitled to night shift allowance then you can demand the payment of the said allowance, if the bank is refusing to pay then you may take it up legally against the bank.

The banking service rules and egulations will be applicable to you if you are a permanent employee hence you can escalate the matter thorugh labor laws also.

You are entitled to overtime wages if you are working beyond the prescribed working hours as per law. Even if there is no clause of overtime in your appointment letter, still you would be entitled to overtime wages. 

As regards, night allowance, go through the terms of your appointment. You can demand the same if such clause exist in your appointment letter. 

If you are planning to take legal action, then instead of asking the HR verbally, send him a short email. In that way, your communication will be documented and he won't be able to deny later.
