Passport scn - adverse police verification

Hi,

My wife's passport was issued from her hometown in Kolkata pre marriage and when it was due for expiry, we got it renewed from Mumbai (we have been staying at the same apartment for 4 years in Mumbai). We got it renewed under "Tatkal" category with post police verification. Afterwards, police verification happened and we submitted all documents asked by the police station. Now after 6 months we got a SCN which just stated - "Adverse Police Verification Report - "It has been reported that applicant is staying on rental basis & not mentioned permanent address in P.P form". Ever since we have been married, both of us have been staying in rented appartments and never in our hometown (for last 10 years). Under the circumstance, why should this be a problem? Is there a law in this country that a passport will only be given to someone who owns a property (and stays in it)? We are completely lost and it seems like a ground for harrassment only. Request advice on the course of action to get this resolved.

Thanks in advance for your advice.

P.S: The SCN does not mention any act or anything about imponding or surrendering the passport. In this case what are the implications of this SCN?

Ministry
has
been
receivirg

include
the
registered
rent
agreement
as
one
of
the
valid
documents
for
proof
of
address
in
respect
of
tenants
for
grant
of
passport
facilities
to
them.
2.
The
matter
has
been
considered
in
consultation
with
the
Legal
&
Treaties
(L&T)
Division
of
the
Ministry
and
it
has
now
been
decided
that
henceforth,
the
registered
rent
agreement
duly
registered
under
Section
17
of
the
Registtation
Act,
1908
and
executed
in
favour
of
the
tenant
by
the
landlord
for
a
pedod
of
more
than
one
year,
wlll
be
accepted
as
a
valid
proof
of
address
for
the
purpose
of
the
submission
of
passport

application

In the application for renewal of passport,  the particulars about rented accommodation and permanent address are to be given separately, there are separate columns asking the details accordingly. You should have noticed it and should have filled up the form very carefully, your negligence at that time has resulted into the present show cause notice.  However, even now you can give a letter/reply explaining the circumstances which have been asked to explain by the passport authorities. In addition you may attach an affidavit stating the reasons for not giving the proper details and attach a copy of the rental agreement and other relevant documents to prove your address at that place. without knowing the rules properly do not blame or criticise the law of the land.
