Permanent alimony

Hello sir, 

I am already paying 25,000/- monthly alimony to spouse and minor child. Divorce has been granted by the high court based upon the cruelty as myself and family members has acquitted from 498A charges and wife filed appeal in seesion court against the acquittal which consititures immense cruelty to husband.

Now, can she entilted for permanent alimony after divorce though already paying 25,000/- monthly alimony ? 

Please advise.

Nothing is impossible if you try well.

In which section you are paying maintenance?

There are some cases where court held that if wife unable to prove cruelty than she is not entitiled for maintainance.

 

It is tough to get these type of favourable orders but you do not have other obtions left.

10 to 15 years of what you are paying now as monthly maintenance will be summed up as lumpsum for one time settlement of permanent alimony provided you have no other source of income (properties) on your name.

(or)

If she don't have any remarriage plans, then the same monthly maintenance will be continued as permanent alimony till her death along with an option of revision whenever require depending on circumstances to claim increase in quantity.
