Dear Mitul,

Taking care of parents is a moral responsibility. If one brother is not taking care of parents other brother cannot sue him for the same. Its the parents who can proceed with filing a case u/s 125 of Cr. P. C. for maintenance before Court of Law. Parents as you said are ailing have a good ground to be maintained by the son who isn't supporting them financially.

only parents can demand for maintenance to another brother also, But first brther  can't do for this, He can't legaly force to another brother.

Parents have to file case against brother for get maintenance u/s 125 Cr.pc
