Stamp Duty

What is the stamp duty on partition deeds? Is it necessary to pay the duty on the market value?

No it is not necessary to pay stamp duty on the market value in partition deed effected among family members. The stamp duty can be paid on a notional value of the property.

there is a property in my mothers name in delhi purchased in one lac in 1997,my mother died in apr 2007 now wheather for registration of relinquish deed in one of my brother we have to deposit stamp duty(16100/sq mtrs)

Most of the States in India have their own Stamp Acts. For example in Gujarat under the provisions of Bombay Stamp Act, Stamp Duty is payable on the market value of the property to be partitioned .

For family partition 1% of the value subject to maximum Rs. 10,000/-
