Title of property

How does it effect the Title of a property, if one son of the landlord after his father's  demise builds an additional floor without written consent of other legal heirs of the landlord  and without proper sanction of the municipal authorities having jurisdiction over the property.

title of the property remains same, but the additional construction will not give any special right to the said son, further if the construction is without proper sanction then the muncipalicy can initiate legal action against the property including demolition of the construction

Thanks for your response.If the son is investing a substantial amount of money in the propery after the demise of his father, is he not trying to create a better title on this property for him vis-a- vas his other sibling? can you please clarify.

well investing money in the property by any one would not create any difference in the tittle of the property unless there is any agreement regarding the same with the owner of the property and morally though the person may have own understanding with others regarding such expenditure but the legal status of the property remain the same.

his motive may be to create better title, but unless he gets consent from his other brothers, law will not recognise such motive

additional construction made by any person cannot, in any manner, conveys a better title to any person.

suppose a person had bought a property on auction at chennai and the existing tenants continue to pay the rents to the existing landlords though the new owner had given notice for the payment of rent what is the ground of eviction of tenants in these cases
