The query is regarding impeachment of elected representative by the voters of his contituency and the reply is in negative. The privileges of legislatures, elected by the people of India, over-ride the fundamental rights of their masters, the people who elect them. However there is provisions for expulsion of an MLA /MP by the Parliament or Legislative Assembly. This happened in cash for query scam when Paliamnet expelled 11 MPs and SC upheld the decision. Punjab Assembly also expelled former Chief Minister.
