This query is : Resolved
A letter is submitted on the Society letter head by the Chairperson of a Society on 01/09/2011 in the Registrar's Office. This chairperson has submitted his resignation on 30/8/2011 which had also been accepted on the same day.
He has put the date of 26/8/2011 on this letter. Can this letter be considered as a valid document. If no can the Society file a criminal complaint against this person who has submitted this letter.

Legally speaking the Chairman had no authority to send the notice in his official capacity when his resignation was already accepted.
Now if it is found that the said Chairman has caused wrongful loss to anyone or has wrongfully gained himself out of that letter then he can definitely be criminally prosecuted.
But still I find he may get a escape route due to predating his letter unless the same could be prima facie established.

on 26/8/11 he was acting as chairman of the society . he was duly elected by all members of managing committee . merely becuase the letter is submitted on 1st september does not mean that letter is not valid . how was letter sent? by hand delivery? or by post?

As mentioned by Mr. Barman you need not make much ado about the letter if it does not result in any wrongful loss to the Society or wrongful gain to himself.
