If the statutory notice of demand u/s.138 is returned undelivered, what is the time limit within which the complaint is to be filed

Within 45 days of intimation date./
Envelop must have date of Intimation/ not claimed/ refused, with postman sign and date.
Count 15 days from that day, Wait for it.
Then in next one month , you must file complaint. [between 15th days to -45th days ]

if you have time to send notice,you can send it again and if the notice again return undelivered wait 15 days and after that you can file a complaint u/s 138 NI Act

What is the exact remaks of the postal authorities on the envelope while returning the registered letter.
That will be crucial. Without knowing it, it will not be possible to give any views to your query.

wait 15 days from the date of intimation then file complaint within 16th to 45th day. Re-sending of notice by regd. post is not advised.
