Overhead water tank

(Querist) 18 April 2025 This query is : Resolved
Sir, we live in a building of four floors and i am the owner of third floor.
Ground floor owner was using a watertank which was common with first floor. Second floor has two tanks and I (third floor) has one tank.
Ground floor owner has installed a new water tank without my permission, intimation or consent.
Now the situation is that ground floor has seperate tank, first floor is using shared water tank exclusively now and second floor like earlier is using two tank and that takes the strength of water tank to 5 for four floors. apart from this, continuous overflow of water owing to broken condition of second floor water tank causing nuisance
Now on a roof, there are five water tanks including my water tank. please guide what action i should take against ground floor to remove the water tank and stop nuisance

As there are only four floors and no society is there, all the owners of each floor shall amicably settle the issue. Why does the owner of the ground floor take your permission? Is the entire site yours?

n general, permission from the local civic body or Municipal Corporation is likely required for installing a new water tank on the terrace of a four-story building .
This is because water tanks are considered a modification to the building's structure and can impact safety and building regulations.
Municipalities and Corporation have specific building regulations and bylaws related to water storage, safety, and structural integrity. Installing a water tank, especially on the roof, can be subject to these regulations.
The weight of a water tank, especially a large one, can put additional stress on the building's structure, and the local authorities may require a check to ensure the building can withstand this additional load.
Therefore you can make a complaint with the local civic body about it and let them inspect and take action as per law

It is better to discuss and sort out the problem / issue amicably.
However, if you are not satisfied and matter is unsettled, report the issue to local water supplying agency, police, municipality and other concerned authorites.

Agreeing with Dr Vasistha, I will add that you problem, appearing genuine may not be understood without local inspection and perusal of documents.

It may not be fair to express any views without understanding whole problem.
