This query is : Resolved
I have 2 PAN nos. While I have been using only one for all my tax/other purposes since 8-10 years. But there were some IT returns filed under both earlier to that. Now when I applied for re-issue of PAN, IT department has sent a letter asking for justification. The other card was not surrendered as I was not using it anyway.
What can be done now?

I think I read some where penalty of 10,000 is there min. Better surrender and finish of that matter with penalty , because now they have started linking aadhar with PAN if I am not wrong.
And again they will catch you some where.
Better approach tax consultant he is use to procedure of income tax dept. than any other person

Thanks Shankar and Madhu. While I understand that I need to surrender, which I will. Is there a way I can avoid penalty. I mean is there some way I can justify that I have not been using it, hence to absolve me of the penalty.

If you have more than one PAN, you should surrender the additional PAN(s) by logging into ITD website at http://incometax.sparshindia.com/pan/newPAN.asp Alternatively, you may fill and submit PAN Change Request application form by mentioning the PAN which you wish to retain on the top of the form. All other PAN/s inadvertently allotted to you should be mentioned and the corresponding PAN card copy/ies should be submitted for cancellation along with the form. Otherwise you can consult with nsdl, If there is any scope for not to be penalised.

You have posted that:
" But there were some IT returns filed under both earlier to that. "
You may have to make correction for ITR filed under additional PAN also.
Local Tax consultant can guide you further.

Surrender one PAN no. and reply to the notice received after consultation with the local tax consultant.

Mr. Sujay,
Yours seems to be a hypothetical query.
By the way, why did you feel the need to reisue the PAN Card?

Reissue was because the present card has worn out/damaged [picture and other details are not clear].

Thanx Kumar Doab. As the earlier ITR were filed more than 10 yrs back, I suppose one cannot do correction beyond 7 yrs. Is my understanding correct.

Mr. Sujay,
In your query you have stated, "IT department has sent a letter asking for justification."
Justification for what? Can you reproduce here the contents of the letter of the IT Department to make the things clear for the experts to help solve your problem?

Tell your CA to present the case instead of applying re-print of the card you applied for fresh card and present to IT Dept. He will be perfect person because he deals under that act and that department routinely . Advocates deal with other laws . Every one have set of law which they deal in .
