no instead of discharge ask for quashing of proceedings
Ajay Bansal (Expert) 10 February 2011
You may avail both oppurtunities i.e quashing of proceedings against you or discharge u/s 239 Cr.P.C. There is no need to show any citation in court as every court is well aware of this position that no case is made out against you.
