(Querist) 28 August 2010 This query is : Resolved 
The accused get anticipatory bail in Mar 2009 for the offence of 420, the conditions is mentioned in anticipatory bail that the accused have to get regular bail in june 2009 before court, but the accused failed to do so,

On Dec 2009 the accused gets the summons from concerned police station which states the police is going to filed chargsheet in the court and therefore the accused have to appear before court on 30/12/2009
……. But the accused failed to do so

The accused also failed to appear on Feb 2010 the date fixed by the court.

Now the next date is 30/10/2010

Whether the accused will get regular bail ?

What the courts will do ?

Whether the accused be arrested on same day ?
Pls reply me urgent ………….

He has to file a bail application. It is the discretionary powers of the court to grant a bail

Obviously the court would have issued NBW due to non appearance at the last hearing. If you appear now,you will detained and remanded. Verify the stage before going to the court and make necessary steps for getting bail.

Hello,
First thing i would like to inform all of you that Anticipatory bail is only till filing of chargesheet so this condition that he will take regular bail from the court or we consider this as the court will hear bail application afresh without considering the order of AB.
If there was any application for his non appearence if not in that case court would have issued bailable or non bailable warrant to insure his presence.
As far as Bail is concern you can move an application for bail in between and get bail on merits from court.
