498a chargesheet

(Querist) 25 October 2013 This query is : Resolved
Hello Respected Expert

My sister in law filled 498a case against my elder brother and parents 2 months back
In our family there are total five meber inluding my wif, as per current FIR myself and my wife is not an accused. and we had taken bail for all three of them.

In the Fir she mentioned few things about my self and my wife like:
1.when ever my brither used to beat her at that time i am encouraging him
2.becaz they are more fear about that how the harresment will took place to only one sister in-law, she said that becaz my wife bring more dowry she has not been harrased.

My question is in the light of above to circumstances what could be the charges police can framed agaist both of us.
OR is there is any chances that our name also going to be included in final chargesheet.

Thanks

Nothing specific allegation is found against you. such vague allegations cannot become base for the police to initiate legal action against you.

It would depend upon Police.
The Police may add your names as co accused persons.
Generally the names of accused persons do not get changed from FIR to CS.

Hello Sir

If at all police framed the charges against us as a co- accused what should be my next step that we need to follow.

Is there is any way to quash our name from the chargesheet

Thanks

fight case on merits

You have to take bail and defend the case on merits. Quashing of charges would be difficult.
