Sir,
I filed 498a case and got an order copy directing police to file FIR from high court bench. My husband applied for bail even before enquiry of police. So the case came for mediation officer. But it s not settled since he s not ready to settle and jewels and srishans. He simply says he is ready to give divorce and nothing else. Now police is not filing fir and if we ask they are telling us to bring the mediation status. It s not yet listed in high court even after 2 months. Please advice his to go further in filing FIR and getting justice?

1. Is the case pending before High Court or Magistrate? The FIR is being filed by police before area Magistrate and not before High Court, please re-check with your lawyer/IO.
2. Even in mediation your husband shall not agree to continue the marriage (in the given circumstances), how and what do you expect in mediation proceedings?
3. Resorting to legal proceedings is root to spoil your married life, peace of mind, finances and happiness, remember.
4. Contact, consult and engage a local lawyer for proper guidance, advise and proceedings in your own interest and benefit.

Then the mention the matter in high court again and inform the reluctance of police to register FIR. You can ask the mediator to close the mediation also since your husband is not ready for mediation.

Ask the mediate to file its report as your husband is not agreeing to your proposal.

Hi all,
This case is pending before high court. Police is asking for the mediation details copy which is not yet listed per my lawyer. In such a situation, how to get it listed and proceed further?

If your lawyer says it is not listed you can ask him itself to how get it listed at the behest of your urgency, he will be having proper answers to your query.
