498a & rcr

Guest (Querist) 07 November 2011 This query is : Resolved
my frnds husband have filed divorce. she has filed 498A and RCR. 498A is for separatin, rcr s for reunion. both are conflicting. whether the polic station n court will accept this?

RCR is a useless case, please see my detailed post on this subject:

http://www.lawyersclubindia.com/forum/Why-not-to-file-restitution-of-conjugal-rights-43385.asp

Try to end the matters amicably, the cases would run for years without much results.

she can make an application under domestic violence act for right to stay in shared household .

ya agreed with Adv. Shonee, and/ or if the guy is not ready to live with her then what??
better try to mutually settle it or go for u/s 13 B (divorce can be possible within 8-9 months)

heard that since he has applid fr divorce, domestic violance act, police statn wont take it.

RCR is not filed in Police Station, it has to be filed in court.

Ld. Manoj Kumar, let me take this opportunity to correct you, I am not a lawyer, I am as yet a law student only.
