6th pay commission

Sir,
A central government employee under B group in the scale of pay Rs.5500-9000 has resigned to the post in 2007 after serving for 18 years 2 months. After one month of resignation, the department was requested to treat his resignation as VRS but the Dept. has not responded. Now is there any provision applicable as per 6th Pay Commission to get pension and gratuity.
