arunprakaash.m. (Expert) 28 February 2009
when a man converts to chiristianity his status becomes as backward community. he cannot claim protection undr sc st atrocities act. still he can take sheild under protection of civil rights act.

he may also take benefit of reservation provided to sc/st under govt. scheme because caste is by birth but he cannot claim protection under sc st Act.

Dear Sidharta,
I partly agree with my learned friends and partly dis agree. If a SC person profesess christianity than he looses his SC status but when a ST person Converts to Chritianity his/her ST status will not be changed. So an ST Christian can take the benefit of SC/ST Atrocitis Act but the converted SC can not take the benefits of Atrocitis Act. Mr Tribhuwan perhaps you are wrong because a SC christian cannot avail the benefit of the Reservation, where as an ST can get all the benefits of ST irrespective religion. Maduripatel case is the guidelines (AIR 1995 SC).Kandhamal(Orissa) where I am resideing is the present issue and for that there were communal violence.

whenever one renounces his religion by conversion, the SC/ST ceases to be a hindu-SC/ST, instead, they treated as christian-BCs. as such, they can not shield them under the Sc/St atrocities act, but under PCR they can claim the protection.
