950 crores scam 17 years ago

(Querist) 03 October 2013 This query is : Resolved
What is the relevance of unrealisable 25 lacs fine for defrauding state exchequer of 950 crores in fodder scams 2~3 decades ago? Such meagre fine is not even a fraction of even the interest of the drained out public funds ? How can our judiciary order recovery of the proven amounts of scams from such convicted politicians ? Why do the sentences under different penal provisions have to be suffered simultaneously which thus makes the sentences mearged into one e.g. 5 years under 120(B) and another 5 years under PRA should mean 10 years to suffer in jail for the convicted ?

Only the wisdom of the judge can prevail in view of the evidence adduced and pleadings of both the parties.

Very valid questions you have raised which i too have.Legislatures have very well exploited the word called democracy keeping people deprived of their rights. In such situations, as is one here, all property of the convict must be taken over by the state
and should be auctioned to realize the loss caused to exchequer, which is public money,if the Constitution has to be respected, and 'we People of India' has to be understood supreme in true sense.

I do appreciate Mr. Singh's concern for the People of Hamara Bharat

Probably, "Mera Bharat Mahaan" is considered only on account of these typical instances created by our leaders!!

In such situations, how can all property of the political convicts be taken over by the state and auctioned to realize the loss caused to exchequer, which is public money
Raj Kumar Makkad (Expert) 06 October 2013
There is no such provision in law as on day and without provision, the judge cannot make his own law taking over entire property of such convict for State.

Is it that Police can attach any criminal's property but not the judge ?
Recently, absconding criminals' property was sealed by Police !
R.K Nanda (Expert) 15 October 2013
police can attach criminals property only on orders of court.
Surrender K Singal (Querist) 15 October 2013
That means the Courts can order attachment of such criminals who have caused huge financial loss to the exchequer by misappropriating public funds for their own gains ?
Devajyoti Barman (Expert) 15 October 2013
We better leave the discussion in the Forum section only.

Mr. Makkad may respond to opinion of Mr. Nanda about Court Orders on attachment ?
R.K Nanda (Expert) 19 October 2013
yes, courts can do it as they have enormous

powers under various laws of india.
