Agreement is between two parties. It is for the parties to decide what they want to incorporate in the Agreement. Whether to keep an Arbitration Clause or not is parties volition.

There is no law which provides that you must have an arbitration clause in an Agreement.
However, the Arbitration Act provides that an Arbitration Agreement must be in writing.

Arbitration clause is not mandatory in an agreement. If you want Arbitration, the clause must be in the agreement. But, if even after the arose of dispute, if both the parties accept for a common arbitrator, they can appoint.
